New Stormwater Permitting Regulations and Green Infrastructure Programs

The New York State Department of Environmental Conservation (DEC) received its first citywide MS4 permit required under the Clean Water Act on August 01, 2015. The intent of this permit is to manage urban sources of stormwater runoff to protect and improve water quality.

Accordingly, New York City is currently developing a citywide Stormwater Management Program (SWMP) Plan that addresses many elements, including: Public Education and Outreach; Public Involvement/Participation; Mapping; Illicit Discharge Detection and Elimination; Construction Site Stormwater Runoff Control; Pollution Prevention; and Control of Floatables and Settleable Trash and Debris.

The new regulations will require a stormwater permit to be obtained prior to any construction approvals from the City. Additionally, the new regulations will require a post-construction maintenance obligation for property owners and managers.
