An owner’s agreements with its architect and contractor are often its two most important contracts on a construction project. While each contract negotiation has its own unique set of issues, certain issues are hotly debated on nearly all contracts. In this program, we will explore the most commonly negotiated issues in owner/architect and owner/contractor agreements, describe each party’s typical viewpoints on these issues, and provide ideas on how to resolve these points of contention.

Learning Objectives:

  • Learn how to negotiate common risk management provisions in your contracts, including provisions related to indemnity, limitation of liability, consequential damages, and insurance. 
  • Understand how to account for building information modeling, and other digital data, on projects through your contracts.
  • Learn how to incorporate sustainability requirements into contracts with architects and contractors.
  • Explore dispute resolutions options for contracts, and advantages and disadvantages of each.
